抵当権侵害のケーススタディ（単位取得）(2011年）
- 単位を取得済みの合格レポートです。抵当権侵害には、債務者・設定者以外の者によるものと、債務者・設定者によるものとがある。いずれのケースにおける抵当権侵害も、物権的請求権と損害賠償請求権に大別され、それぞれに物理的損傷による侵害と占有による侵害がある。抵当権は物権であるため、これが侵害されれば物権的請求権が生じ、また侵害により損害が発生すれば、不法行為に基づく損害賠償請求権が生じる。また、債務者・設定者が侵害者の場合には期限の利益喪失、増担保請求権も問題となる 。このように、抵当権の侵害は、抵当権の価値権としての性格によりその内容が定まる。
